Mulligan:
Law Brings Stricter Punishments for DUI's
July 17, 2002
Des Plaines…This
week, legislation supported by State Representative Rosemary
Mulligan (R- Des Plaines) was signed into law strengthening
the State’s penalties for driving on a revoked or
suspended license as the result of a DUI.
“This is
a law that truly puts the safety and well-being of citizens
first,” said Mulligan. “It will keep dangerous
individuals off the streets and hopefully, prevent tragedies
that should be avoided.”
Senate Bill 1730
became law this week and amends the Illinois Vehicle Code
and the Criminal Code of 1961, and allows for the seizure
and forfeiture of the vehicle of a person convicted of driving
on a revoked or suspended license if the suspension or revocation
was the result of a DUI conviction, a conviction of leaving
the scene of a personal injury accident, a conviction of
reckless homicide, or a violation related to use of alcohol,
drugs, or intoxicating compounds.
Mulligan added
that there is a provision in the law that should the vehicle
be the family’s only source of transportation, and
the spouse of the owner shows hardship, the vehicle may
be turned over to the spouse. However, this provision is
only allowed once per vehicle.
